These are some narrations that should help the wise differentiate between the true scholar and the faker Murji’ah of the Era.<br />

‘ Abdullaah Ibn ‘ Abbaas said that Allaah’s Messenger ( sallallaahu ‘ alayhi wa sallam ) said, “There shall be rulers whom you will recognize from them good and evil. Whoever opposes them is saved. Whoever abandons them is freed. And whoever intermingles with them is destroyed.” (Collected by Ibn Abee Shaybah and at- Tabaraanee<br />

Abul-A’war as- Sulamee said that Allaah’s Messenger ( sallallaahu ‘ alayhi wa sallam ) said, “Be wary of the ruler’s gates; for there, there is difficulty and humiliation.” (Collected by ad- Daylamee and at- Tabaraanee).<br />

Aboo Hurayrah said that Allaah’s Messenger ( sallallaahu ‘ alayhi wa sallam ) said, “Whoever approaches the ruler’s gates becomes afflicted. Whenever a slave draws closer to the ruler, he only gains distance from Allaah .” (Collected by Ahmad; A similar narration, save the last sentence, is reported from Ibn ‘ Abbaas ; at-Targheeb wat-Tarheeb ”).<br />

Jaabir Ibn ‘ Abdillaah said that Allaah’s Messenger ( sallallaahu ‘ alayhi wa sallam ) said to Ka’b Ibn ‘ Ujrah , “O Ka’b Ibn ‘ Ujrah , I seek Allaah’s protection for you from the leadership of fools. There shall be rulers, whoever enters upon them, then aids them in their oppression and validates their lies, then he is not from me nor I from him, and he shall not be admitted to the Hawd . Whoever does not enter upon them, and does not aid them in their oppression, nor validates their lies, then he is from me and I from him, and he shall be admitted to the Hawd .” (Collected by Ahmad, al- Bazzaar , and Ibn Hibbaan ; Similar narrations are reported from an- Nu’man Ibn Basheer , ‘ Abdillaah Ibn Khabbaab (from his father), Abee Sa’eed al- Khudree , and Ka’b Ibn ‘ Ujrah ; at-Targheeb wat-Tarheeb ”).<br />

As for narrations from the words of the Companions, then as- Suyootee has collected from ‘Alee Ibn Abee Taalib, Ibn Mas’ood, Hudhayfah Ibn al- Yamaan , and Abee Dharr , narrations of general warning against approaching the rulers or their gates. See “ Maa Rawaahul-Asaateen Fee ‘Adam al- Majee ’ Ilas-Salaateen ”.<br />

Allâh’s Messenger, sallallâhu ‘alayhi wa sallam said : “He who comes to to the ruler is put to trial.” Reported by Abû Dâwûd (no.2859), at-Tirmidhî (no.2256), an-Nasâ‘î (7/195-196), Ahmad (l/357) and others from Abû Mûsâ al-Ash’arî.<br />

There are too many with similar meanings, so here are some examples:<br />

Ibn Mas’ood said, “Whoever wishes to honor his religion, then he should not enter upon the ruler.” (Collected by ad- Daarimee ).<br />

Ibn Mas’ood also said, “A man enters upon the ruler, carrying his religion with him, then exits without anything with him.” (Collected by al- Bukhaaree in his “ Taareekh ” and Ibn Sa’d in “at- Tabaqaat ”).<br />

<br />
Hudhayfah Ibn al- Yamaan said, “O indeed! Never should any of you walk even a hand-span in the direction of the ruler.” (Collected by Ibn Abee Shaybah ).<br />

<br />
<br />
He collects from the later scholars of the Salaf , similar narrations from Sufyaan ath-Thawree , Sa’eed Ibn al- Musayyib , Hammaad Ibn Salamah , al- Hasan al- Basree , Ibn al- Mubaarak , Abee Haazim , al- Awzaa’ee , and al- Fudayl Ibn al-‘ Iyaad .<br />

Sufyaan at- Thawree said, “Don’t go, even if they ask you to visit them just to recite ‘ qul huwallaahu ahad ’.” (Collected by al- Bayhaqee ).<br />

<br />
Maalik Ibn Anas said, “I met more than ten and some Taabi’een , all of them saying, do not go to them, do not admonish them, meaning the ruler.” (Collected by al- Khateeb al- Baghdaadee in “ Ruwaah Maalik ”).<br />
<br />
<br />
<br />
Sufyaan ath-Thawree said, “Looking at the ruler is a sin.” (Collected by Abee ‘Alee al- Aamudee in his “ Ta’leeq ”).<br />
<br />
<br />
<br />
Bishr al- Haafee said, “How disgusting is it to request to see a scholar, but then to get the response that he is at the ruler’s gate.” (Collected by al- Bayhaqee in “ Shu’ab al-Eemaan”).<br />

Ibn al-Jawzî (d.597H) - rahimahullâh - says in Talbîs Iblîs (p.121-122):<br />

“From the deception of Iblîs upon the Scholars, is their mixing with the Rulers and flattering them and abandon censuring them when able to do so. And perhaps they find allowance for them where really there is no allowance, in order to attain a worldly goal - and threefold corruption comes about through this:<br />
<br />
<br />
<br />
Firstly: The Ruler - he says: If it were not correct, then the Scholar would have censured me - and how can I not be correct - and he eats from my wealth?<br />
<br />
<br />
<br />
Secondly: The common person says: There is no harm with this Ruler, nor his wealth, nor his actions, because the Scholar does not criticise him.<br />
<br />
<br />
<br />
Thirdly: The Scholar - because he corrupts his Dîn through that. Iblîs may deceive them into entering upon the Ruler saying: We enter in order to intercede for a Muslim. This deception is uncovered by the fact that if a different person entered to intercede - the Scholar would not be pleased with that; and perhaps speak ill of him - since he wishes to be alone in the Rulers attention.<br />
<br />
<br />
<br />
So entering upon the Ruler involves great danger, since the intention may be good when you first enter, but then may be changed by their honouring you, or bestowing things upon you, or by having ambitions and by not being able to avoid flattering them and leaving-off censuring them. Sufyân ath-Thawrî used to say: “I do not fear from their debasing me, but I fear from their being generous towards me so that my heart inclines towards them.” ”<br />

And al-Hâfidh Ibn Rajab al-Hanbalî (d.795H) says in Sharh Hadîth Mâ Dhi’bân (p.53):<br />

<br />
“Many of the Salaf used to forbid entering upon the Kings in order to command them with what is good and forbid them from what is evil also. From those that forbade them were: ‘Umar ibn ‘Abdul-’Azîz, Ibn al-Mubârak, ath-Thawrî and others. Ibn al-Mubârak said: “And with us, the one who orders and forbids is not the one who enters upon them and orders and forbids, but rather the one who orders and forbids is the one who keeps away from them.” And that is for fear of trials for the one who enters upon them since a person when far away maybe deceived into thinking that he will order and forbid them and be stern with them - but when he sees them face to face, his soul inclines towards them, since love of nobility is hidden in the soul. Therefore he flatters them and is lenient with them and perhaps he inclines towards them and comes to love them, especially if they treat him kindly and generously and he accepts that from them. And this happened to ‘Abdullâh ibn Tâwûs with a certain ruler, in the presence of his father Tâwûs, so Tâwûs rebuked him for that. And Sufyân ath-Thawrî wrote to ‘Abbâd ibn ‘Abbâd and in his letter was: And beware of the rulers…”<br />

Ibn ‘Abdul Barr (d.463H) - the Scholar of Andulus - says in Jâmi’ Bayannil-‘Ilm (l/185-186), ending the chapter in which he mentioned the Salaf’s hatred of entering upon the kings and rulers:<br />

“And the meaning of this chapter is with regard to the wicked oppressive ruler. However, as for the just and noble of them, then entering upon him, seeing him and helping him to do good is one of the best of good deeds. Do you not see that ‘Umar ibn ’Abdul-’Azîz was accompanied by the great Scholar such as ’Urwah ibn az-Zubair and his level; and Ibn Shihâb az-Zuhrî and his level. And Ibn Shihâb used to enter upon the ruler ‘Abdul-Mâlik and his sons after him. And from those who used to enter upon the ruler were:- ash-Sha’bî, Qabîsah, Ibn Dhu’aib, Rajâ‘ ibn Haywat al-Kindî, Abûl-Miqdâm - who was a noble scholar, al-Hasan, Abûz-Zinâd, Mâlik ibn Anas, al-Awzâ’î, ash-Shâfi’î and others too many to mention. So if the Scholar enters upon the ruler - now and again when there is a need - and he says what is good and speaks with his knowledge, then that is good and a means of Allâh’s pleasure until the Day he meets Him. But these sittings are usually a trial; and being safe therefrom is abandoning what is in them.”<br />

Last of all; Sufyân ath-Thawrî on his famous naseeha to ’Abbâd ibn ’Abbâd al-Khawwâs al-Arsûfî says:<br />

Beware of the Rulers. Beware of coming near to them and of mixing with them in any of the affairs. Beware of being deceived, so that it said to you: Intercede [for me], so that you help one oppressed, or repel an act of oppression - because that is from the deception of Iblîs, which the wicked reciters have taken as a means to attain a favorable position. It used to be said: Beware of the fitnah (trial) of the ignorant worshipper and the wicked scholar, because the trial of these two is indeed a trial for everyone put to trial.<br />
<br />
<br />
<br />
What remains is the matter that: isn’t speaking the truth in the face of a tyrant the greatest Jihad? The answer: Yes, but other similar narrations mention why it is the greatest Jihad and martyrdom, because after he commands the good and denounces evil, the ruler kills him. This is the real speaking of the truth, not the following of desires and visiting the ruler daily until the scholar is one of his personal advisors and henchmen. The Salaf were afraid that most people were too weak to stay firm in the face of the tyrant, but instead would be affected by his power and wealth, thereby justifying religious compromise with the ruler, which is exactly what we see these days from our “scholars.” How wise were the Salaf , and how foolish are the Khalaf .<br />

Important Point: These narrations warn against approaching tyrannical, MUSLIM rulers, so what of those rulers who apostate by aiding the infidels against the Muslims, or by legislating manmade laws, or ruling by manmade laws, etc.<br />

Shaikh ul-Islaam Ibn Taymiyyah said: “and it is known from the religion (of islam) by necessity and by the consensus (ijmaa) of all the Muslims that whoever legalizes to follow other than the religion of Islaam or a Shari’ah other than the Shari’ah of Muhammad (sallallahu alayhe wa salam) he is a disbeliever and his disbelief is similar to that of the one who believes in some part of the book (Quran) and rejects some of it” {Al-Fataawa, Volume 28, page 524}<br />
<br />
<br />
<br />
Ibn Taymiyyah also said {Al-Fataawa: Volume 28, Pages 510 – 512): “Every group which rebels against mutawaatir (clear-cut), law of the Islamic Shari’ah must be fought by the consensus (ijmaa) of all the Imaams (leaders) of Muslims, even if they pronounce the Shahaada (declaration of faith). So if they attest the Shahaadah and refuse to perform the five prayers, then they must be fought until they perform them (the prayers: and if they refuse to pay Zakaah, then they must be fought until they pay it, and so must they be (fought) if they refuse to fast in the month of Ramadhan or perform Hajj. Likewise if they refuse to prohibit fawaahish (evil deeds), zina (adultery), maysar (gambling), khamr (wine), and the other things which Shari’ah forbids. Also they must be fought if they refuse to judge between themselves in the affairs of murder, money, honours, marriage and so on by the Quraan and the Sunnah, or if they abstain from al-amr bil ma’roof wan nahi ‘anil munkar (enjoining good and forbidding evil), fighting the disbelievers until they accept Islaam or pay the Jiziah in order to abase the disbelievers. Likewise if they manifest atheism in Allah’s name, belying his verses, his attributes, decree and destiny and what the Jam’ah (group) of Muslims were upon during the time of the rightly guided Khulafaa (plural of Khaleef) or insulting the early Muhajireen (those who migrated to Madinah with the prophet sallallahu alayhe wa salam and the Ansaar (the Helpers – from the city of Madinah) and those who followed them, or fighting Muslims until they obey them in a way that will cause the Muslims to rebel against the Islamic Shari’ah and the like of these things, Allah (ubhana wa Ta’ala) says:<br />

‘And fight then until there is no fitnah (disbelief and polytheism, worshipping others besides Allah) and the religion (worship) will all be for Allah (in the whole world)’ {Surat Al-Anfaal:39}<br />

<br />
<br />
So if a part of the religion is for Allah and another is for other than him, fighting is obligatory until the religion is for Allah (alone). Allah (subhana wa Ta’ala) says:<br />

‘O you who believe! Fear Allah and give what remains (due to you) from Riba (usury) if you (really) are believers, and if you do not do it, then take a notice of war from Allaah and His Messenger’ {Surat Al-Baqarah: 278/279}<br />

<br />
This verse was revealed about ahl at-Taif (the people of Taif) who embraced Islaam, prayed and fasted, but they were dealing with usury, which was the final prohibition in the Quraan and it is a money taken by the satisfaction of the dealers. So if the person who does not abstain from it is at war with Allaah and Messenger (sallallahu alayhe wa salam), what about those who abandon several Islamic laws or most of them, such as the Tartars?” {Al-Fataawa: Volume 28, Pages 510 – 512)<br />

Isa Ibn Sinan narrated that, he heardh Wahb Ib Munabbih saying to Ata al-Khorasani: “Don’t be a slave at the gate of the kings; because there are such fitnah, which smells like camels shed (a place which camels rest). Whatever you gain from their wordly life, they will take away that much from your religion.” Imam al-Ajurri, Akhlaku’l-Ulama<br />

for this reason, we declare as a Kafir, the one who legislates in accordance with the Din of democracy (legislation for the people, by the people), just as we also declare as a Kafir, the one who chooses, appoints, or elects on his behalf, a legislator. Having said that, we do not declare as Kuffar, the generality of people who participate in the elections, for not all of them seek legislating lords in their participation in it. Rather, from them are those that seek to choose representatives for worldly services for living. In this matter the tribulation has spread far and wide. And the motives of the candidates for election differ-among those that do not directly take part in or practice legislation, such as the representatives. For that reason, we do not proceed to pronounce Takfir of the individuals among them as we do with those that directly perform clear Kufr such as legislation and its likes.<span class="Apple-converted-space"> </span><br />
<br />
And we say: taking part in legislative elections is an action of Kufr and we do not make general Takfir. Rather, we differentiate between a persons performance of an action of Kufr, and placing the ruling of Kufr upon him, of what that implies of establishing the evidence if the affairs become confused and the matters become mixed up, as well as the consideration [given to] the motives in the likes of these issues.</span></span><br />

A person works for the Police and due to his dire financial condition he cannot even leave this job because he is neither educated nor has any alternative source of income to this job. <a name='more'></a>Bear in mind that he is not only the caretaker of his wife and children; but he also has to provide financial help to his parents and brothers because, the income from the work that his father and brothers do is not enough to eke out a living. Their financial condition is very bad and they are counted among those who are needy. <br />
<br />
So…..Honorable Shaykh Abu Waleed Al-Maqdisi ! give us a fatwa about such a person. May Allah Ta’ala have mercy on you and protect you and give you the strength to speak the truth.<br />

In the name of Allah and may salutations and peace be upon the Prophet of Allah, his Companions and those who follow them.<br />

And what follows…..<br />
<br />
There is no doubt that Police and all the other such institutions have been created to remove Allah’s law and replace it with manmade laws. For any wise Muslim who is concerned about his religion, it is impermissible for him to <br />
<br />
work in such kind of Kafir institutions. Conversely, he must keep himself and his Iman safe from the filth of such polytheistic institutions. This is because, these are the institutions which bear the sin of enforcing the laws of other than Allah’s and the same ruling applies to the person who works in such institutions. As far as the issue of decrease in Rizq(sustenance) and paucity of wealth is concerned…..! then these reasons cannot provide the justification for committing such (heinous) sins.<br />
<br />
Allah says:<br />
<br />
<b>And they say: “If we follow the guidance with you, we would be snatched away from our land.” Have We not established for them a secure sanctuary (Makkah), to which are brought fruits of all kinds, a provision from Ourselves, but most of them know not. (Qasas: 57)</b><br />
<br />
So remember…! Committing an act of Kufr is in no circumstances permissible unless for the one who is forced and helpless and has been compelled in such a way that there is danger of loss of life or limb.<br />
<br />
Allah says:<br />
<br />
<b>Whoever disbelieved in Allah after his belief, except him who is forced thereto and whose heart is at rest with Faith, but such as open their breasts to disbelief, on them is wrath from Allah, and theirs will be a great torment. That is because they loved and preferred the life of this world over that of the Hereafter. And Allah guides not the people who disbelieve. They are those upon whose hearts, hearing (ears) and sight (eyes) Allah has set a seal. And they are the heedless! No doubt, in the Hereafter, they will be the losers. Then, verily! Your Lord for those who emigrated after they had been put to trials and thereafter strove hard and fought (for the Cause of Allah) and were patient, verily, your Lord afterward is, Oft-Forgiving, Most Merciful. (An-Nahl: 106-110)</b><br />
<br />
Remember what Allah Subhana wa Ta’ala has mentioned about the person who does Kufr without compulsion; the reason which encouraged him to do Kufr is his preference for this worldly life over the hereafter. So, whoever does that (i.e. gives preference to worldly life), then such a person qualifies to have his heart, hearing and sight sealed. This is because he is among those who are oblivious, accursed and losers on the Day of Judgment.<br />
<br />
So the one who desires salvation must leave the way of Kufr and Shirk; and give preference to the Hereafter over the worldly life. He must in this context, wage Jihad against his own self, desires and against the devils among the Jinn and mankind. And he must bear with patience all of which he suffers in this path. In this way, maybe Allah Ta’ala will forgive his sins and have mercy on him. Without doubt Allah is the most Beneficent and Merciful.<br />
<br />
Also remember that…..! one who fears Allah Subhana wa Ta’ala; He creates for him, the way out of hardship and provides him with sustenance from such avenues which he never would have imagined.<br />
<br />
Allah says:<br />
<br />
<b>And whosoever fears Allah and keeps his duty to Him, He will make a way for him to get out (from every difficulty). And He will provide him from (sources) he never could imagine. And whosoever puts his trust in Allah, then He will suffice him. Verily, Allah will accomplish his purpose. Indeed Allah has set a measure for all things. (At-Talaq: 2-3)</b><br />
<br />
And Allah says:<br />
<br />
<b>and whosoever fears Allah and keeps his duty to Him, He will make his matter easy for him. (At-Talaq: 4)</b><br />
<br />
And then, his family, his parents and his parents cannot save him from Allah’s punishment. On the contrary, they will run away from him on the Day of Judgment.<br />
<br />
Allah says:<br />
<br />
<b>That Day shall a man flee from his brother, And from his mother and his father, And from his wife and his children. Everyman, that Day, will have enough to make him careless of others. (Abasa: 34-37)</b><br />

We pray that may Allah give him and others like him, the strength to tread the path of the Believers and keep them away from the path of those who were destroyed.<br />

<span style="font-family: Verdana,serif;"><span style="font-size: small;">Islam stipulates certain conditions for taking the wealth of the disbelievers. According to our classical scholars,<a name='more'></a> it becomes permissible to take the disbelievers wealth for jihad-related purposes even if one is without an army or an Imam; and even within this there are restrictions. Due to the unfamiliarity of some on this subject, I felt the need to clarify this.</span></span><br />
<br />
<span style="color: black;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">The Messenger of Allah<span class="Apple-converted-space"> </span></span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">(SAW)<span class="Apple-converted-space"> </span></span></span><span style="color: black;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">said, “</span></span></span><span style="color: maroon;"><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>I was sent before the hour with the sword, and my sustenance is under my spear, and humility and belittlement is the destiny of whoever defies my commands.</i></span></span></span><span style="color: black;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">”</span></span></span><span style="color: blue;"><span style="font-family: Verdana,serif;"><span style="font-size: small;"><b>[1]</b></span></span></span><br />

<span style="font-family: Verdana,serif;"><span style="font-size: small;">This great ĥadīth reveals some important aspects about our religion:</span></span><ul><li style="font: 12px tahoma,verdana,geneva,lucida,'lucida grande',arial,helvetica,sans-serif;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">Muhammad (SAW) was sent with the sword: The Messenger of Allah (SAW) and the mujahidin after him carried the light of Islam to humanity by fighting in Allah's cause.</span></span></li>
<li style="font: 12px tahoma,verdana,geneva,lucida,'lucida grande',arial,helvetica,sans-serif;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">The greatest form of income is that of the spoils of war and the greatest profession is being a soldier in the path of Allah. The income generated from booty taken by force from the enemies of Allah is purer and more virtuous than income generated from being a businessman, an engineer, a physician, or a farmer, simply because that was the source of income that Allah destined for his Messenger Muhammad (SAW). Working as a mujahid is sunnah.</span></span></li>
<li style="font: 12px tahoma,verdana,geneva,lucida,'lucida grande',arial,helvetica,sans-serif;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">Eventually all the enemies of the Messenger of Allah (SAW) and his ummah would be shamed and humiliated.</span></span></li>
</ul><span style="font-family: Verdana,serif;"><span style="font-size: small;">It is narrated that some of the şaĥābah who moved to the land of al-Sham for jihad began acquiring farms and cultivating them. These were fertile lands with an abundance of water that they were not used to seeing in their native lands of Hijaz. When the<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>khalīfah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">Umar heard that, he waited until harvest season and right before the şaĥābah started harvesting their land. He then ordered that they be burnt to the ground. He then assembled the şaĥābah and told them: "Farming is the role of the people of book. You should be fighting in the cause of Allah."</span></span><span style="color: blue;"><span style="font-family: Verdana,serif;"><span style="font-size: small;"><b>[2]</b></span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">Umar did not want the şaĥābah to be tied down to this earth by professions that would hold them back from jihad in the path of Allah.</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">They wanted to be free from restrictions that would enslave them like the rest of humanity. The statement of Umar implies that the people who are attached to this life, the people of the book, should do this menial work. But you, the Muslims, should seek your provisions by the strength of your swords.</span></span><br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">The Messenger of Allah (SAW) worked as a shepherd and then as a businessman before Islam. But after he received the revelation he gave that up and devoted his entire time to spreading the message of Islam. So contrary to what many people believe, Rasūlullāh (SAW)did not work after he became a prophet. When he made hijrah to Madinah his provisions were from the spoils of war.</span></span><br />
<br />
<span style="color: black;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">Some Muslims today might feel uncomfortable consuming money that was seized by force from the disbelievers and would feel that income they receive as a salary or from business is a better form of income. That is not true. The best and purest form of income is booty. The Messenger of Allah<span class="Apple-converted-space"> </span></span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">(SAW)<span class="Apple-converted-space"> </span></span></span><span style="color: black;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">said: "</span></span></span><span style="color: maroon;">…</span><span style="color: maroon;"><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>and the spoils of war are made halal for me…</i></span></span></span><span style="color: black;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">"</span></span></span><span style="color: blue;"><span style="font-family: Verdana,serif;"><span style="font-size: small;"><b>[3]</b></span></span></span><br />

<span style="color: #001605;"><span style="font-family: Verdana,serif;"><span style="font-size: small;"><b>I. Ghanīmah and fai’</b></span></span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">These are the two types of wealth that are taken from the enemy. Following is the definition of each:</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>Ghanīmah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">is the money taken from the disbelievers by force by the strength of the mujahidin and in a way that raises the word of Allah.</span></span><span style="color: blue;"><span style="font-family: Verdana,serif;"><span style="font-size: small;"><b>[4]</b></span></span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>Fai</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">' is what is taken from the disbelievers without fighting.</span></span><span style="color: blue;"><span style="font-family: Verdana,serif;"><span style="font-size: small;"><b>[5]</b></span></span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">Rulings of<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">and<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>fai</i></span></span>’<span style="font-family: Verdana,serif;"><span style="font-size: small;">:</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">After<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">is collected, one fifth of it is taken away in what is called "</span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>takhmīs</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">" which I would refer to from now on as the "one-fifth rule". The rest (80%) is distributed among the fighters. There is a difference of opinion on how the one-fifth is then distributed. Some say it should be spent on jihad while others say it should be spent on the needs of Muslims while others say a portion of it should be spent on the scholars and judges of the Muslim state.</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">As for the money of<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>fai</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">', it belongs to the Muslim treasury.</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">So the difference between<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">and<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>fai</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">' is that four-fifths of the<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">belongs to the mujahidin while none of the<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>fai</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">' belongs to them.</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">Can<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">and<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>fai</i></span></span>’<span class="Apple-converted-space"> </span><span style="font-family: Verdana,serif;"><span style="font-size: small;">be taken from the disbelievers in the West today?</span></span><br />

<span style="font-family: Verdana,serif;"><span style="font-size: small;">To answer this question we would need to answer the following two questions first:</span></span><blockquote><span style="font-family: Verdana,serif;"><span style="font-size: small;">1. Are the nations of the West classified as<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>dār al-ĥarb<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">(land of war) or<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>dār al-'aĥd<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">(land of covenant)?</span></span><br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">2. If the West is<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>dār al-ĥarb</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">, are the Muslims who live there bound by a covenant that prohibits them from harming their countries of residence?</span></span></blockquote><span style="font-family: Verdana,serif;"><span style="font-size: small;">The answer to the first question:</span></span><br />

<span style="font-family: Verdana,serif;"><span style="font-size: small;">First of all there is no Islamic leadership authorized to enter into covenants with the nations of disbelief in the present day. This is because the governments of the Muslim world have lost their legitimacy for many reasons, among them:</span></span><ul><li style="font: 12px tahoma,verdana,geneva,lucida,'lucida grande',arial,helvetica,sans-serif;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">Governance according to man made laws.</span></span></li>
<li style="font: 12px tahoma,verdana,geneva,lucida,'lucida grande',arial,helvetica,sans-serif;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">Taking the disbelievers as allies.</span></span></li>
<li style="font: 12px tahoma,verdana,geneva,lucida,'lucida grande',arial,helvetica,sans-serif;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">Fighting the<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>awliyā</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">' of Allah.</span></span></li>
</ul><span style="font-family: Verdana,serif;"><span style="font-size: small;">Therefore any agreements or treatise between the governments of the Muslim world and other parties are considered to be<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>bāţil</i></span></span><span class="Apple-converted-space"> </span><span style="font-family: Verdana,serif;"><span style="font-size: small;">(illegitimate).</span></span><br />

<span style="font-family: Verdana,serif;"><span style="font-size: small;">Second: Any nation that enters into war with the Muslims, or participates in invading a Muslim land has by de facto become<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>dār al-ĥarb</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">. Therefore all of the Western nations that have an active participation in the occupation of Afghanistan or Iraq or any other Muslim land are considered to be<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>dār al-ĥarb</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">.</span></span><br />

<span style="font-family: Verdana,serif;"><span style="font-size: small;">The answer to the second question:</span></span><br />

<span style="font-family: Verdana,serif;"><span style="font-size: small;">This is a critical issue and therefore would be covered in a separate paper,<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>In Shā’ Allāh</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">. However, my conclusion on this matter is that Muslims are not bound by the covenants of citizenship and visa that exist between them and nations of<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>dār al-ĥarb</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">.</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">It is the consensus of our scholars that the property of the disbelievers in<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>dār al-ĥarb<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">is halal for the Muslims and is a legitimate target for the mujahidin. Again this is a matter of consensus so there is no need to elaborate further on this point.</span></span><br />

<span style="font-family: Verdana,serif;"><span style="font-size: small;">In the encyclopedia of fiqh it states that: "The property of the 'people of war' and their blood is halal for the Muslims and none of that is protected. Muslims have the right to take their lives and their belongings by all available means, because they do the same to us. This is an issue of consensus among the scholars."</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">In the past, Muslim armies would march into the lands of the disbelievers and would then confiscate their wealth and distribute it according to the rules of shari’ah: If the wealth was taken after fighting, it is<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah</i></span></span><span class="Apple-converted-space"> </span><span style="font-family: Verdana,serif;"><span style="font-size: small;">and if it was taken without fighting it is<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>fai</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">'.</span></span><br />

<span style="font-family: Verdana,serif;"><span style="font-size: small;">Now since the modern form of jihad is according to the guerrilla style of warfare rather than the conventional style that existed for the most part of our history, how does this affect the rulings of<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">and<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>fai</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">'?</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">Today jihad is more clandestine and is performed by underground networks.</span></span><span class="Apple-converted-space"> </span><span style="font-family: Verdana,serif;"><span style="font-size: small;">The question that arises is: Can these networks of mujahidin use clandestine methods to appropriate wealth from the disbelievers in<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>dār alĥarb</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">?</span></span><span class="Apple-converted-space"> </span><span style="font-family: Verdana,serif;"><span style="font-size: small;">And if yes, is it<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>fai</i></span></span>’<span class="Apple-converted-space"> </span><span style="font-family: Verdana,serif;"><span style="font-size: small;">or<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">or neither? Further, how is it distributed?</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">To the credit of our early scholars, even these issues have been answered by them and are covered in our books of fiqh. So all praise is due to Allah, we do not have to refer to many of the present day scholars who are either trying to appease the apostate governments of the Muslim world or are trying to appease the Jews and the Christians.</span></span><br />
<br />
<span style="color: black;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">If one would research our classical books of fiqh, one would find that out of the four<span class="Apple-converted-space"> </span></span></span></span><span style="color: black;"><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>madhab’s</i></span></span></span><span style="color: black;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">, the Hanafi School has covered such topics the most. This is probably because the Hanafi School was the official state<span class="Apple-converted-space"> </span></span></span></span><span style="color: black;"><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>madhab<span class="Apple-converted-space"> </span></i></span></span></span><span style="color: black;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">for the longest period in our history compared to other schools. It therefore covers issues relating to jihad in more detail because the foreign policy of the Islamic state was jihad in the path of Allah. I would therefore start by quoting the Hanafi books of fiqh first:</span></span></span><br />

<span style="color: #001605;"><span style="font-family: Verdana,serif;"><span style="font-size: small;"><b>The Hanafi position:</b></span></span></span><span style="color: black;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">Al-Natiqi narrates that Imam Abu Hanifah used<span class="Apple-converted-space"> </span></span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">to say: "If an individual enters alone into<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>dār al-ĥarb<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">and has taken booty and there are no Muslim soldiers in that territory then it is not subjected to the one-fifth rule. That is the case if they are less than nine men. If they reach nine then they are considered a"</span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>sarīyah</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">" (A combat group)."</span></span><br />

<span style="font-family: Verdana,serif;"><span style="font-size: small;">So according to Imam Abu Hanifah, if the group is less than nine, what they seize is not<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">and therefore they are not obligated to submit one fifth</span></span><span style="color: blue;"><span style="font-family: Verdana,serif;"><span style="font-size: small;"><b>[6]</b></span></span></span><span class="Apple-converted-space"> </span><span style="font-family: Verdana,serif;"><span style="font-size: small;">of it to the Muslim authorities.</span></span><br />

<span style="font-family: Verdana,serif;"><span style="font-size: small;">In<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>al-Hidāyah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">by Imam al-Mirghanani it states: "If one or two individuals enter<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>dār al-ĥarb<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">without the permission of the Imam and they take something, then it is not subjected to the one-fifth rule."</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">Here the author is stating that whatever is taken from the land of war by individuals and not by an army is not subjected to the regular rules of<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">.</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">Al-Zayghali in his commentary on<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>al-Hidāyah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">entitled, "</span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>Naşb al-rāyah fītakhrīj aĥādīth al-hidāyah</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">" explains the preceding statement by saying:</span></span><br />

<span style="font-family: Verdana,serif;"><span style="font-size: small;">"This is because<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">is what is taken by force and not by means of theft or embezzlement and the rule of one-fifth only applies to<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">. Now if this individual or pair of individuals enter with the permission of the Imam then there are two opinions. The most famous is that what they seize is subjected to the one-fifth rule because the permission of the Imam means that he is obligated to protect them by reinforcements if they are endangered and thus they have a protection force and (the author of<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>al-Hidāyah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">states) "If a group who has a force enters and takes something, it is subjected to the one-fifth rule even if they didn’t seek permission from the Imam." This is because it is taken by force so it is considered<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">and the Imam is still obligated to protect them because if he doesn’t then that will weaken the Muslims, unlike if only one or two persons enter then he is not obligated to protect them.""</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">Al-Zayghali is considering that what is taken is treated as<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">if the individual or group of individuals has a force to protect them. This is not the case today with the mujahidin since there is no Imam or Islamic authority to offer them protection. Similar statements are made in other Hanafi references of fiqh such as "</span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>al-Mabşūt</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">" and "</span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>Sharĥ al-Saer al-Kabīr</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">" both by Imam al-Sarkhasi.</span></span><br />

<span style="font-family: Verdana,serif;"><span style="font-size: small;">Therefore the Hanafi School considers that the one-fifth that is taken out from the booty and handed over to the Amir is in exchange of his protection. If this protection doesn’t exist then the individuals or group of individuals are not obligated to pay anything. So if an individual takes wealth from the disbelievers in the land of war and he does not use force but takes it by means of theft or embezzlement, it is not considered<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">according to the Hanafi School. So then what is it?</span></span><br />

<span style="font-family: Verdana,serif;"><span style="font-size: small;">We find the answer in another Hanafi reference, "</span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>al-Jawharah al-Nayerah</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">" by Abu Bakr al-Abbadi who states in his commentary on<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>al-Hidāyah</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">: “If one or two individuals enter<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>dār al-ĥarb<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">without the permission of the Imam and they take something, then it is not subjected to the one fifth rule, because it is not</span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah</i></span></span><span class="Apple-converted-space"> </span><span style="font-family: Verdana,serif;"><span style="font-size: small;">since<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">is what is taken by force and not by theft or embezzlement. But if one or two persons enter with the permission of the Imam then there are two opinions. The famous opinion is that it is divided into five portions, four of which goes to the ones who seized it. The second opinion is that it is not divided into five portions because it was taken by means of theft. The first opinion is the strongest because since the Imam permitted them, then they have taken it under his protection and not by theft." He continues, “If a group who has force enters and takes something, it is subjected to the one-fifth rule even if they didn’t seek permission from the Imam, because the group has strength and therefore what is taken by them is considered<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">. But if they are a group who doesn’t have a protection force and they enter without the permission of the Imam then what they take is not considered<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah</i></span></span><span class="Apple-converted-space"> </span><span style="font-family: Verdana,serif;"><span style="font-size: small;">because<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">is what is taken by force and these people are similar to thieves because they steal secretly and therefore it is not<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">. Therefore, in this case what each individual seizes is for him and no one has a share in it because it is considered<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>mubāĥ<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">(permitted) just like hunting or wood gathering."</span></span><br />

<span style="font-family: Verdana,serif;"><span style="font-size: small;">Notice here that Imam al-Abbadi compares this booty to hunting and wood gathering. This is because wild beasts and timber in the forest are not the "rightful property" of anyone. The reasoning behind comparing booty to hunting and wood gathering is because the property which exists in the hands of the disbelievers is not considered to be rightfully theirs in our Islamic shari’ah because of their disbelief and when Islam does give them the right to own it, it is an exception to the rule such as in the case of<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ahl al-dhimma<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">after they pay<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>jizyah</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">. This is why our scholars say that Allah has called booty as "</span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>fai</i></span></span>’<span style="font-family: Verdana,serif;"><span style="font-size: small;">" which means "to return", so they say that the property of the disbelievers that doesn’t belong to them has "returned" to the believer: its "rightful owner."</span></span><br />

<span style="font-family: Verdana,serif;"><span style="font-size: small;">In "</span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>al-Sear al-Saqhir</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">" (Hanafi) the author states: “If one, two or three men from amongst the Muslims or the<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ahlal-dhimmah</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">, who have no protecting force, enter into<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>dār al-ĥarb<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">without the permission of the Imam and they take booty and return with it to the land of Islam, then all of what they take is theirs and there is no one-fifth taken from it.”</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">The situation of Muslims living today in<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>dār al-ĥarb<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">would be similar to the above-mentioned case. The Muslims have no Imam to seek permission from, they have no protecting force, and what they can take would be by means of theft and embezzlement. So according to the rules set by the Hanafi School, the money seized by Muslims who are in<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>dār al-ĥarb<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">can be appropriated in its entirety by themselves.</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">However, I would like to note that even if a Muslim today is allowed to do that, there are some points that need to be taken into consideration:</span></span><span class="Apple-converted-space"> </span><span style="font-family: Verdana,serif;"><span style="font-size: small;">The Hanafi’s stated that a Muslim is "permitted" to steal money from the disbelievers in<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>dār al-ĥarb<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">but they didn’t state that there is a reward in doing so. They related that it is similar to hunting or wood gathering. In other words it is similar to making a living using other halal methods. However, we as Muslims should seek the wealth of the disbelievers as a form of jihad in the path of Allah. That would necessitate that we spend the money on the cause of jihad and not on ourselves.</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">We do not want such a fatwa to be misused by Muslims who are not concerned with jihad and are just interested in improving their own lot. The result of wide misuse of such a fatwa would cause authorities to restrict Muslims and view them with suspicion, which would eventually backfire on the ones who would truly want to serve the cause through such a fatwa.</span></span><br />

He says: "Al-Ghazali said that if a Muslim steals money from the disbelievers then the entire amount becomes his property and the one-fifth is not taken from it.</span></span><br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">Al-Rafi'i adopts the opinion that the thief owns four-fifths of it just like all money of<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah.</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">"</span></span><br />

<span style="font-family: Verdana,serif;"><span style="font-size: small;">Even though the majority opinion among the Hanbali school is that what is taken is<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">, the author above here mentions another opinion and that it is</span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>fai</i></span></span>’<span style="font-family: Verdana,serif;"><span style="font-size: small;">. It means that the entire amount needs to be handed over to the Imam to be distributed according to his discretion.</span></span><br />

<li style="font: 12px tahoma,verdana,geneva,lucida,'lucida grande',arial,helvetica,sans-serif;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">Our scholars differ on how wealth taken by means of theft and deception should be divided. The majority believes it is<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">. So one-fifth of it should be paid to the Amir to be spent on jihad. Alternatively, the Hanafi’s consider it to be a source of income that belongs in its entirety to the ones who seized it. Finally, there is a minority opinion that it is<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>fai</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">' and therefore should be distributed according to the discretion of the Amir.</span></span></li>
</ul><span style="color: #001605;"><span style="font-family: Verdana,serif;"><span style="font-size: small;"><b>Implications on our present day work:</b></span></span></span><span style="color: black;"><span style="font-family: Verdana,serif;"><span style="font-size: small;"><span class="Apple-converted-space"> </span>Every Muslim who lives in<span class="Apple-converted-space"> </span></span></span></span><span style="color: black;"><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>dār al-ĥarb<span class="Apple-converted-space"> </span></i></span></span></span><span style="color: black;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">should avoid paying any of his wealth to the disbelievers whether it be in the form of taxes, duties, or fines. If a Muslim is allowed to deceive the disbelievers to appropriate their wealth then he is also allowed to deceive them to avoid paying them his wealth.</span></span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">Even though it is allowed to seize the property of individuals in<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>dār al-ĥarb</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">, we suggest that Muslims avoid targeting citizens of countries where the public opinion is supportive of some of the Muslim causes. <li style="font: 12px tahoma,verdana,geneva,lucida,'lucida grande',arial,helvetica,sans-serif;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">Wealth belonging to disbelievers with known animosity towards Muslims</span></span></li>
</ul><span style="font-family: Verdana,serif;"><span style="font-size: small;">In the case of the United States, both the government and private citizens should be targeted. America and Americans are the Imam’s of<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>kufr</i></span></span><span class="Apple-converted-space"> </span><span style="font-family: Verdana,serif;"><span style="font-size: small;">in this day and age. The American people who vote for war mongering governments are intent on no good. Anyone who inflicts harm on them in any form is doing a favor to the ummah.</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">Careful consideration should be given to the risk vs. Benefit (i.e.,<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>maslaĥa</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">) of any specific operation. Because of the very negative implications of an operation that is exposed, it is important that the benefits outweigh the risks.</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">For Muslims who are associated with groups that work for jihad, we recommend that the decision to involve oneself in any illegal activity to acquire money from the disbelievers be taken by the Amir and the<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>shūrā<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">of the<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>jamā'ah</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">. We say this because since there is a liability on the<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>jamā'ah</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">, the decision needs to be made by the<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>jamā'ah</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">. We also recommend that the decision on how to spend the money be left to the Amir and the<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>shūrā</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">. We need to mention however that if the</span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>jamā'ah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">adopt the view that what is seized is considered<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">, then if a percentage less than 80% is to be given to the ones who seized it, that needs to done with the agreement of the participants of the operation because according to the rules of<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">they are entitled to the full 80%. The same is said if the<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>jamā'ah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">follows the Hanafi opinion.</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">It is recommended that Muslims who are not associated with groups that work for jihad and who acquire wealth from the disbelievers by illegal means to donate all that money to the cause of jihad unless if they are in need then they can take from it accordingly but not to exceed 80%. Islamic work cannot depend on volunteers. In order to support brothers who are willing to work full-time for Islamic causes, their income can be taken from wealth seized from the disbelievers. This should be one of the categories in which appropriated money is spent. This is especially important with jihad oriented groups because it is the work chosen only by the best of the best and therefore there is only a small pool of human resources that exists. So it is important to have as many brothers as possible devote their time to the work rather than spend their prime time seeking a living and only giving their spare time for the work. They should follow the sunnah of the Messenger of Allah (SAW) and live off of<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>ghanīmah</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">. This is especially important for brothers who are in positions of leadership in their<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>jamā'ah</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">.</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">Since jihad around the world is in dire need of financial support, we urge our brothers in the West to take it upon themselves to give this issue a priority in their plans. Rather than the Muslims financing their jihad from their own pockets, they should finance it from the pockets of their enemies.</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">In the end I would like to respond to what some weak Muslims might say that such<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>fatāwā<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">would "tarnish the image of Muslims in the West" and are "not good for the<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>da’wah</i></span></span>”<span style="font-family: Verdana,serif;"><span style="font-size: small;">.</span></span><br />

<span style="font-family: Verdana,serif;"><span style="font-size: small;">In response to the claim that such<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>fatāwā<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">would "tarnish the image of Muslims in the West," I would say:</span></span><ul><li style="font: 12px tahoma,verdana,geneva,lucida,'lucida grande',arial,helvetica,sans-serif;"><span style="color: black;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">Since when did the West have a good image of Islam and Muslims to start with? The West has always held Islam and Muslims in contempt. Just look at Western literature and to the portrayal of Muslims in the Western media.</span></span></span></li>
<li style="font: 12px tahoma,verdana,geneva,lucida,'lucida grande',arial,helvetica,sans-serif;"><span style="color: black;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">The only way for them to have a good image of you is to become like them. Allah says: {</span></span></span><span style="color: green;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">The Jews and the Christians will not be pleased with you until you follow their way</span></span></span><span style="color: black;"><span style="font-family: Verdana,serif;"><span style="font-size: small;">} [2: 120].</span></span></span></li>

And such<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>fatāwā<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">are going to support the sword. So eventually it is good for<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>da’wah</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">. When the Messenger of Allah (SAW) was giving<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>da’wah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">in Makkah for thirteen years, only a few hundred became Muslim. When he made hijrah to Madinah, within ten years, over a hundred thousand became Muslim. So how come his<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>da’wah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">in Madinah was much more fruitful than his<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>da’wah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">in Makkah? That was because he was using a superior form of<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>da’wah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">in Madinah and that is the<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>da’wah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">of the sword.</span></span></li>

It therefore supersedes<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>da’wah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">in importance because<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>da’wah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">is<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>sunnah mu'akkadah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">(recommended act) or</span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>farđ kifāyah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">(communal obligation) at most. So anything that supports jihad should take precedence over things that support<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>da’wah</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">.</span></span></li>
</ul><span style="font-family: Verdana,serif;"><span style="font-size: small;">Dear brothers: Jihad heavily relies on money. In Qur’an, the physical jihad is associated with jihad with one's wealth in eight verses. In every verse but one, jihad with wealth preceded the physical jihad. That is because without wealth there can be no jihad. Our enemies have realized that. Therefore they are "following the money trail" and are trying to dry up all the sources of funding "terrorism".</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">Our jihad cannot depend wholly on donations made by Muslims. The</span></span><span class="Apple-converted-space"> </span><span style="font-family: Verdana,serif;"><span style="font-size: small;">Messenger of Allah (SAW) sent many armies for the sole purpose of raiding caravans of the disbelievers. Not only was jihad financed by booty but also throughout our early history them Islamic treasury itself was mostly dependent on income generated from jihad. A tax called<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>kharaj<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">was placed on land opened by Muslims, enslaved POWs would be sold, and the people of the book paid<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>jizyah</i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">. All of these sources were generated through jihad. Zakah and<span class="Apple-converted-space"> </span></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;"><i>Şadaqah<span class="Apple-converted-space"> </span></i></span></span><span style="font-family: Verdana,serif;"><span style="font-size: small;">represented only a small portion of the income of the Muslim government.</span></span><br />
<br />
<span style="font-family: Verdana,serif;"><span style="font-size: small;">It is about time that we take serious steps towards securing a strong financial backing for our work rather than depending on donations.</span></span><br />

The reasoning of the Hanafi's is that taking interest from the disbelievers is taking money that is halal for us to start with since their lives and property are halal for Muslims. <span style="font-family: Times New Roman;"><span style="font-size: small;">His martyrdom as well as that of his comrades,<span class="Apple-converted-space"> </span><span style="color: #004c22;">Abu Muhsin al-Ma'ribi</span>,<span class="Apple-converted-space"> </span><span style="color: #004c22;">Sameer Khan</span><span class="Apple-converted-space"> </span>and<span class="Apple-converted-space"> </span><span style="color: #004c22;">Salim al-Marwani</span>, may Allah have mercy on them all, was a result of an American airstrike in an area between Ma'rib and Jawf.<span class="Apple-converted-space"> </span></span></span></b><b><br />
<br />
<span style="font-family: Times New Roman;"><span style="font-size: small;">By Allah's Grace, the Sheikh and Islamic preacher was killed while he remained firm in the path of Da'wah and Jihad, while both global and local pressure were unable to cause him to retract from it, despite lengthy attempts of seduction and threat, imprisonment and pursuit.<span class="Apple-converted-space"> </span></span></span></b><b><br />
<br />
<span style="font-family: Times New Roman;"><span style="font-size: small;">This Islamic preacher is the one who achieved victory, by his beliefs, as remaining firm on beliefs is the true victory. He died upon his beliefs, as we reckon. This is a characteristic of the Muslim Ummah; their leaders do not die on their beds. The honor and the victory of the Ummah is that their leaders and preachers are martyred.</span></span></b><span class="Apple-converted-space"> </span><b><br />
<br />
<span style="font-family: Times New Roman;"><span style="font-size: small;">Has any true call or the nation ever lived without sacrifices? If not, then we are an Ummah which never dies! Rather, it is victorious, it lives, and it is persists, because death gives it life!</span></span></b><span class="Apple-converted-space"> </span><b><br />
<br />
<span style="font-family: Times New Roman;"><span style="font-size: small;">The Americans assassinated the Islamic preacher, Sheikh Anwar Al-Awlaqi and Sameer Khan without any brought proof of allegation, and they presented no evidence according to their own criminal laws of “freedom”.</span></span></b><span class="Apple-converted-space"> </span><b><br />
<br />
<span style="font-family: Times New Roman;"><span style="font-size: small;">Where are their calls of freedom, justice, and human rights and freedom which they claim? America was so harmed by them that they contradicted their own principle, which they do daily, on which they claim their country was founded.</span></span></b><span class="Apple-converted-space"> </span><b><br />
<br />
<span style="font-family: Times New Roman;"><span style="font-size: small;">America is the one who failed, as they did not abide by their principles, while the Sheikh proved victorious, as he lived according to his beliefs and died upon them.</span></span></b><span class="Apple-converted-space"> </span><b><br />
<br />
<span style="font-family: Times New Roman;"><span style="font-size: small;">And thus does America commit acts of injustice and aggression, killing on a daily basis. Indeed they have a dark history in the likes of these crimes, too lengthy to be recorded. They fabricate brazen lies in public, claiming to be the protectors of human rights, freedom and justice.</span></span></b><span class="Apple-converted-space"> </span><b><br />
<br />
<span style="font-family: Times New Roman;"><span style="font-size: small;">Their mendacious king makes a public appearance, stating that the death of Sheikh Anwar al-Awlaqi is a victory for the Yemeni people, because the Sheikh, according to him, killed many Yemeni people. But Obama, the yo-yo who changes his religion daily, that he was found confessing to the fact that he killed hundreds of the Sheikh's fellow tribesmen in Ma'jalah and Rafadh, most of them women, children and the elderly, with the blessings and participation of the butcher of Yemen, Ali Saleh.</span></span></b><span class="Apple-converted-space"> </span><b><br />
<br />
<span style="font-family: Times New Roman;"><span style="font-size: small;">The Sheikh has proceeded to the Everlasting Gardens, Allah willing, while leaving behind for the Ummah a clear and pure ideology, a distinguished style, and a path of Da'wah and Jihad which the Ummah can adopt in their march towards honor and victory.</span></span></b><span class="Apple-converted-space"> </span><b><br />
<br />
<span style="font-family: Times New Roman;"><span style="font-size: small;">Yes, America has killed Sheikh Anwar, may Allah have mercy on him, but they can never kill his ideology. Rather, the martyrdom of the Sheikh is a new and revived life of his ideology and style.</span></span></b><span class="Apple-converted-space"> </span><b><br />
<br />
<span style="font-family: Times New Roman;"><span style="font-size: small;">The Sheikh has students which he taught, and students which have benefited from him in various parts of the world. They will march his march, following his tracks, continuing on the straight path, the path of the Prophet sallallahu alaihi wa sallam.</span></span></b><span class="Apple-converted-space"> </span><b><br />

<span style="font-family: Times New Roman;"><span style="font-size: small;">As for American politicians, people have become accustomed to the fact that whenever they kill a leader of Islam, or whenever one of its heroes is martyred, they start to imagine things, saying that they have finished off Islam or the Muslim Ummah, that the Muslim Ummah is now impotent, or on that day they have achieved a great victory by killing such-and-such Muslim.</span></span></b><span class="Apple-converted-space"> </span><b><br />
<br />
<span style="font-family: Times New Roman;"><span style="font-size: small;">Indeed it is only their imagination, as they are fighting an entire nation and a magnificent religion. They are fighting the Nation of True Monotheism (Taweed) and Jihad. How on earth can they think to break its resolve?!</span></span></b><span class="Apple-converted-space"> </span><b><br />

<span style="font-family: Times New Roman;"><span style="font-size: small;">These patchy techniques, as well as the injustices of America against the entire world, and its continual support of the Jews and the idol-tyrant rulers, its proxies in various regions, have led Muslim masses to revolt and step into the fields, in outright refusal of the idiotic policies of America, their injustices against the entire world, and their support of their proxy rulers who they have placed over their neck.</span></span></b><span class="Apple-converted-space"> </span><b><br />

A Statement Marking the Martyrdom of Imam Anwar al-Awlaki and Samir Khan - May Allah Have Mercy on Them</span></b><br />
</span></span><div align="left"><span style="font-family: Book Antiqua;"><span style="font-size: small;">In the name of Allah, the Most Kind, the Most Merciful.<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">The Islamic Ummah has heard confirmation today that Imam Anwar al-Awlaki and three of his brothers were martyred by US missiles in Yemen.<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">We ask Allah (SWT) to have mercy on all of those martyred, and to grant them the highest levels of Paradise. We at the AMEF ask Allah to accept the martyrdom of all four of the brothers. In this brief statement we would like to focus especially on the two brothers we knew best: two brothers who have done an enormous amount of work to spread Glad Tidings to English-speaking Muslims across the globe.<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">This is not meant to be a wistful lament for the passing of our brothers, but rather a celebration of their accomplishments in the dunya, and congratulations for transaction which they have concluded, which was indeed their supreme achievement.<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">For Allah (SWT) says:<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;"><span style="color: green;">"And say not of those who are killed in Allah's cause: "They are dead" Rather they are alive, but you perceive not"<span class="Apple-converted-space"> </span></span>[Surah al-Baqarah: 154]<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">And He (SWT) also tells us:<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;"><span style="color: green;">"Allah hath purchased of the Believers their persons and their goods; for theirs (in return) is the garden (of Paradise): they fight in His cause, and slay and are slain: a promise binding on Him in truth, through the Law, the Gospel, and the Qur'an: and who is more faithful to his covenant than Allah? then rejoice in the bargain which ye have concluded: that is the supreme achievement"</span><span class="Apple-converted-space"> </span>[Surah At-Tawbah: 111]<br />

</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;"><span style="color: red;">Imam Anwar al-Awlaki:</span><br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">The Imam was the perfect example of that rarest and most precious of commodities: a righteous scholar who speaks the Truth.<span class="Apple-converted-space"> </span><br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">While the West has waged war against Muslims from Iraq to Afghanistan the Ulema in the West have remained silent. Allah knows best whether they are afraid of being thrown into prison, or of being deported from their new homes, or simply of losing the power and prestige they have found themselves growing increasingly fond of, the fact remains they have been silent. Imam Anwar al-Awlaki was an anomaly in that he spoke the Truth and did not fear the consequences.<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">As Allah (SWT) says:<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;"><span style="color: green;">"O you who believe! Whoever from among you turns back from his religion, Allah will bring a people whom He will love and they will love Him; humble towards the Believers, stern towards the Disbelievers, fighting in the Way of Allah, and never fearing the blame of the blamers"</span><span class="Apple-converted-space"> </span>[Al-Maidah: 54]<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">The Imam was well aware that he could be imprisoned for what he said, that he could be denied visas to travel to other Western nations, that he could become a social pariah - a stranger in his own land.<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">As the Imam of the Mujahideen - Prophet Muhammad (peace be upon him) said:<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;"><span style="color: blue;">“Islam began as something strange, and it shall return to being something strange, so give Glad Tidings to the strangers”</span><span class="Apple-converted-space"> </span>[Sahih Muslim]<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">But even among the very few scholars who dare to speak the Truth, Imam Anwar al-Awlaki was still a rarity. For he was not content to merely talk about Jihad, he wanted to 'practice what he preached'. He left a comfortable life in America and made Hijrah to Yemen, and joined his brothers in Al-Qaeda in the Arabian Peninsula.<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">It has been ten long years since the start of the Crusader war on Afghanistan - who can honestly still say that the time is not right for them to make Hijrah, that they are still making preparations?<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">Hasn't Allah (SWT) warned us about those who are forever 'preparing' for Hijrah and Jihad:<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;"><span style="color: green;">"If they had intended to come out, they would certainly have made some preparation therefor; but Allah was averse to their being sent forth; so He made them lag behind, and they were told, "Sit ye among those who sit (inactive)"</span><span class="Apple-converted-space"> </span>[Surah at-Tawbah: 46]<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">Even imprisoning the Sheikh did not silence him, it only seems to have spurred him on to continue his dawah.<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">The Sheikh was insulted, cursed, belittled and hit with a constant streams of accusations. But never once did his resolve waver, nor once did he compromise his Faith, never once did he fear the blame of the blamers!<br />

</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;"><span style="color: red;">Samir Khan:</span><br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">Our brother Samir, may Allah have mercy on him, is well-known to all the members of the English-speaking jihadi forums. He was a frequent contributor on the forums, and via his blogs, until he also decided to answer the call of Amir Abu Baseer (may Allah protect him) and make Hijrah to Yemen.<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">It is worth pointing out that brother Samir left his home and family, knowing that he would be called an extremist, knowing he would face many hardships along the way, and knowing that he would most likely never return.<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">Our brother used the same online username consistently: Inshallahshaheed. Let us ponder this fact for a moment: brother Samir, may Allah have mercy on him, was seeking martyrdom right from the start. After he proved his intentions were sincere - by actually making Hijrah and not just talking about it - Allah granted him that which he sought so earnestly (we reckon him to be so, and Allah is his Reckoner)<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">Our brother Samir, may Allah have mercy on him, joins the long and illustrious list of brothers from the forums who have been martyred in the path of Allah. The list includes names that will live long in Islamic history, such as Abu Dujana al-Khurasani from Al-Hesbah and Mu'sab Sayyid from Al-Firdaus, but it also contains the names of many brothers who weren't as well known.<span class="Apple-converted-space"> </span><br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">Like the heroes Abu Dujanah al-Khurasani and Mu'sab Sayyid (may Allah have mercy on them both) Samir has left us with much beneficial material, compiled before his date with destiny. Prophet Muhammad (peace and blessings be upon him) said:<span class="Apple-converted-space"> </span><span style="color: blue;">“When a man dies, his deeds come to an end except for three things: Sadaqah Jariyah (ceaseless charity); knowledge which is beneficial; or a virtuous descendant who prays for him”</span><span class="Apple-converted-space"> </span>[Sahih Muslim]<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">We ask Allah that the sermons of Imam Anwar and the writings of Samir Khan continue to 'Inspire the Believers', and continue to add to the balance of their good deeds.<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">We ask the brothers involved in producing English-language jihadi material to redouble their efforts, so that we actually see an increase in the quality and quantity of English-language jihadi material being produced, instead of a decrease as the Kuffar are hoping.<br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">We ask Allah to make the brothers at AMEF, GIMF, Dar al-Murabiteen, Ansurullah and all other English-language jihadi media outlets successful in their attempts to assist His Deen.<span class="Apple-converted-space"> </span><br />
</span></span><span style="font-family: Book Antiqua;"><span style="font-size: small;">We ask Allah to unite their vision, fortify their ranks, and protect them from the plots of the Murtadeen and the Kuffar.<br />

And they did not alter by any alteration.”</span></div><div style="background-color: transparent; border-width: 0px; margin: 0px 0px 24px; padding: 0px; text-align: justify; vertical-align: baseline;">And they did not change in the least… indeed this is how we can describe the two martyrs of America, the two martyrs of Yemen, the Sheikh, the Da’i, the speaker of truth, the one true to his word, the Muhajir, the Mujahid, Anwar al-Awlaqi, and the bold and the daring, the fearless, the creative, resolute and ambitious Muhajir and Mujahid Sameer Khan.</div><div style="background-color: transparent; border-width: 0px; margin: 0px 0px 24px; padding: 0px; text-align: justify; vertical-align: baseline;">Both in their own way were thorns in the side of America.</div><div style="background-color: transparent; border-width: 0px; margin: 0px 0px 24px; padding: 0px; text-align: justify; vertical-align: baseline;">One, a famous preacher who moved people’s hearts and brought them to tears, who brought to life the lives of the Prophets, the Prophet (peace be upon him) and the Sahabah, inculcating into the Muslim diaspora the values lost due to negligence, revitalizing the spirit of fraternity and Jihad. In his gradual transition into the Mujahid Da’i he longed to be, he took his audience with him as well. As a result, there are hundreds of Nidal Hasans’ waiting to strike when it is deemed suitable.</div><div style="background-color: transparent; border-width: 0px; margin: 0px 0px 24px; padding: 0px; text-align: justify; vertical-align: baseline;">Another, a lost Muslim youth who was guided back to the truth, not partially, but wholly, discovering the lost and neglected dimension of Jihad waiting for him to uncover. He did not turn back, but with his ingenuity and resoluteness, creativity and braveness, he brought that dimension to those who never had seen it, and in ways appreciated by all, and the realities of the new Crusades have now become almost common knowledge.</div><div style="background-color: transparent; border-width: 0px; margin: 0px 0px 24px; padding: 0px; text-align: justify; vertical-align: baseline;"><span id="more-3269" style="background-color: transparent; border-width: 0px; margin: 0px; padding: 0px; vertical-align: baseline;"></span></div><div style="background-color: transparent; border-width: 0px; margin: 0px 0px 24px; padding: 0px; text-align: justify; vertical-align: baseline;">Little had they known that they would cross paths in the Land of Faith and Wisdom, the Land of Aid and Jihad, the land of Yemen, the Felix of Arabia.</div><div style="background-color: transparent; border-width: 0px; margin: 0px 0px 24px; padding: 0px; text-align: justify; vertical-align: baseline;">From there they expanded their dreams, speaking out to the world in ways never imagined. padding-left: 5px; padding-right: 5px; text-align: justify; text-indent: 10px; unicode-bidi: embed;">އޭރުގެ ސަރުކާރުން އަފްރާޝީމް ގެނެސްގެން ހިންގި ހަމަނުޖެހުމުގެ މައްޗަށްވާހަކަފުޅު ދައްކަވަމުން ވިދާޅުވިއެވެ:</div><div style="direction: rtl; padding-left: 5px; padding-right: 5px; text-align: justify; text-indent: 10px; unicode-bidi: embed;">[މިއީ ވަރަށްވެސް މުޙިއްމު ނުކުތާއެކެވެ. އެހެނީ ދިވެހިރާއްޖެ "ފުރިހަމަ ޑިމޮކްރެސީ" އަކަށް ހެދުމަށް އެންމެހާ ކުފުރީ ބާރުތަކުން މިހާރުވަނީ އަމާޒުކަނޑައަޅާފައެވެ. މިއީ ދިވެހި ސަރުކާރާއި، ޔޫރަޕާއި އެމެރިކާއާއި، އަދި ޚުދު އެމް.ޑީ.ޕީގެވެސް ފައިދާއަށްޓަކައި ކުރެވޭކަމެކެވެ. އެހެނީ ޔޫރަޕުގެ ޑިމޮކްރެސީ ލަނޑުދަނޑީގެ ފެށުމަކީ އާނިޔާ އާއި އަފްރާޝިމް ކަމުގައިވިޔަސް އޭގެ ނިމުމަކީ ކުރިސްޓިއަންދީނާއި ފައްޅިތަކެވެ. އާއެކެވެ. ޙަޤީޤަތަކީ މިއީއެވެ. އެހެނީ ކުއްލިޔަކަށް އެކި ދީނުގެ މައްސަލަގަޑެއް، ޒަމާނުއްސުރެން އިސްލާމްދީނަށް ނިސްބަތްވަމުން އަންނަ އިސްލާމީ ބަޔެއްގެ ތެރެއަށް އައިސްފިނަމަ، ޢާންމުންގެ ތެރޭ އިންތިހާ ރުޅިވެރިކަން އުފެދި، މަސްލަހަތު އެކީއެއްކޮށް ނެތިދާނެއެވެ. އެހެނަސް މިފަދަ ބަޔެއްގެ ތެރޭގައި "ދީނީ ޑިމޮކްރެސީ" ގެނެވޭނީ ފިޔަވަހި (phased changes) ތަކަކުންކަން އެމެރިކާއާއި އެންމެހާ ކުފުރިއްޔާތުތަކެއް ދަނެއެވެ.</div><div style="direction: rtl; padding-left: 5px; padding-right: 5px; text-align: justify; text-indent: 10px; unicode-bidi: embed;">މިގޮތުން ފުރަތަމަ ފަތުރާ އެއްޗަކީ އެތަނެއްގައި ޢާންމު މަސްރަޙައި ނުގުޅޭފަދަ، މީގެ މާނައީ، މަޛްހަބުގެ ތަފާތެކޭ ނޫނެވެ، އެހެނަސް ވަރަށް ބޮޑެތި ޢަޤީދާގެ ފަރަޤުވާފަދަ ދީނީ ހަމަނުޖެހުންތަކެއް ގެނައުމެވެ. އަދި އަފްރާޝީމަކީ އޭގެ މިޘާލެކެވެ. މިފަދައިން ޢަޤީދާގެ ތަފާތުތަކަށް ދިވެހިން (tolerate) "ކެތްތެރިވާން" ފެށުމުން، ދެން ފަށާނީ އެއާއި ޖެހިގެން އޮތްފިޔަވައްސެކެވެ. މިގޮތުން މަޑުމަޑުން ދިވެހިން ދީނީ ފަރަޤުތަކަށް "ކެތްތެރި" ކުރުވަމުން ކުރުވަމުން ގޮސް ނިމިގެންދާނީ ޔަހޫދިއްޔަތާއި ނަޞާރާއިންގެ ފައްޅިތަކަށްވެސް "ވެލްކަމް" ކިޔުއްވުމުންނެވެ. އަދި މިއީ ތުރުކީ އާއި ޤަޠަރާއި މޮރޮކޯއާއި އަދި މިނޫންވެސް އެންމެހާ އިސްލާމުން އުޅެމުންދާ ބިންތަކުގައި ޢާންމު އަދި ކާމިޔާބު ލިބިފައިވާ މަޝްރޫޢު އެކެވެ. އެހެންނޫންނަމަ ލޮބުވެތި ނަބިއްޔާ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ގެ ބިމުގައި، އަދި އެބިމަކަށް ޤުރުއާނުގެ ވަޙީ ހަތް އުޑުގެ މަތިން ބާވައިލެއްވުނު ބިމުގައި، ނަޞާރާ ފައްޅިއެއް އެޅިދާނެހެއްޔެވެ؟ އަދި އެބިމެއްގައި އިސްލާމީ ޚިލާފަތުގެ ވެރިކަން ކުރި ބިމުގައި، ޚުދު އާދައިގެ ތިންކަން ބުރުޤާވެސް މަނާކުރެވިދާނެހެއްޔެވެ؟ އެހެނަސް އަދުގެ ޙަޤީޤަތަކީ މިއީއެވެ!" padding-left: 5px; padding-right: 5px; text-align: justify; text-indent: 10px; unicode-bidi: embed;">އަބޫ ޒުބައިދާ ވިދާޅުވިފަދައިން ފުރަތަމަ ފިޔަވަހީގައި ހިމެނެނީ އެހެންދީންތަކަށް ދިވެހިންނަށް އުޅުމުގެ މިނިވަންކަން ހުޅުވާލުމެއްނޫނެވެ. އެހެނަސް އަޤީދާގެ ބޮޑެތިތަފާތު ކަންކަމަށް ދިވެހިން ދިރުވުމެވެ. މިމޭރުމުން އަޅުގަނޑުމެން ބަލާލާއިރު، ދީނީ ތަޤުރީރު ކުރމުގެ ހުއްދަދެވޭ ފަރާތްތަކުގެ ޝަރުތުތަކުން "ސުންނަތް ޖަމާޢަތުގެ މީހެއްކަމުގައިވުން" މިޕޮއިންޓް ރައީސް އޮފީހުން ކަނޑާފައިވުން ފާހަގަވެއެވެ. މީގެ މާނައަކީ "ސުންނަތް ޖަމާޢަތުގައި ނުހިމެނޭ" މިސާލަކަށް، ހައްދުފަހަނައެޅި ޤަބުރަށް އަޅުކަން ކުރާ ސޫފީ "ޝެއިޚުން" ގެ އިތުރުން އިސްލާމްދީނާ މުޅިން ޚިލާފު "ޝިއަޢީ" އިމާމުންނާއި އަދި ރަޝާދު ޚަލީފާ އަކީ ރަސޫލެއްކަމަށް އީމާންވެގެން ތިބި "ޤުރުއާނިސްޓުންގެ" ޝެއިޚުންނަށްވެސް ހުއްދައެއް ލިބިދާނޭކަމެވެ. މިފަދަޝައިޚުން ފަތުވާ ދިނުން ހުއްދަ ކުރުމަށްޓަކައި އަންނަނިވި މާއްދާ އުނިކޮށްފައިވެއެވެ: "ދިވެހިރާއްޖޭގައި ދީނީ ކަންކަމުގެ ޙުކުމްތައް ބަޔާންކުރަންވާނީ ސުންނަތްޖަމާޢަތާ އެއްގޮތަށެވެ." އެހެންކަމުން ސުންނަތް ޖަމާޢަތާއި ޚިލާފަށް މިޘާލަކަށް ޝިޔައީ ދީނާއި އެއްގޮތަށް ޙުކުމްބަޔާންކޮށް ފެތުރުމަކީ ހުއްދަކަމެކެވެ. އަދި ސަރުކާރުން ގެންނަ އެފަދަ "ޓީޗަރެއް" ނޫނީ "ޚަތީބެއް" އާންމުން ތެރޭ މައްސަލަޖެހުނަސް ޑީޕޯޓުވިއަ ނުދިނުމަށްޓަކައި، "<span style="text-decoration: underline;">ސުންނަތް ޖަމާޢަތުގެ</span><span class="Apple-converted-space"> </span>މަޛްހަބު ނޫން އެހެން މަޛްހަބެއްގެ ގޮތާއި ޢަޤީދާ ފަތުރަން މަސައްކަތްކުރާ" މީހުން ޑީޕޯޓުކުރުން ނުވަތަ ރާއްޖެއަށް އުމުރަށް ނާދަވޭގޮތަށް ފޮނުވާލުމުގެ ނުކުތާ ވަނީ ފޮހެލާފައެވެ.</div><div style="direction: rtl; padding-left: 5px; padding-right: 5px; text-align: justify; text-indent: 10px; unicode-bidi: embed;">މިއާއި ދެކޮޅަށް ބުނާ ބޭފުޅެއް ހުއްދަދެވެނީ ވަކި ތަންތަނަކުން ކިޔަވައިގެން ތިބި ބަޔަކަށް ކަމަށް ބުނެފާނެއެވެ. އެހެނަސް ޙަޤީގަތަކީ ޖަމިއްޔަތުއްސަލަފުގެ ރައީސް، ލޮބުވެތި އަޚް އައްޝެއިޚް އަބްދުﷲ ބިން މުޙައްމަދު އިބްރާހީމް ވިދާޅުވި ބަސްފުޅެވެ. ޝެއިޚް އެންމެ ހަރުކަށިކޮށް ބަޔާންކުރެއްވީ މިޤަވާޢިދުގެ ދެވަނަ މާއްދާގެ (ރ) ގައި ހިމެނޭ ނުކުތާއަށެވެ. އެއީ އިސްލާމިކް މިނިސްޓްރީއިން ފެންނަ ބަޔަކަށް (ކިޔެވުމުގެ މިންގަނޑާއި ތަނުގެ ޤަވާޢިދަށް ނުބަލައި) ދީނީ ހުއްދަ ދެވިދާނޭކަމަށެވެ. އަދި އިސްލާމިކް މިނިސްޓްރީއަކީ މުސްތަޤިއްލު ތަނަކަށް ނުވާހިނދު އެއިރެއްގެ ސަރުކާރުގެ ނުފޫޒާއި އެއްގޮތަށް މިހުއްދަ ބޭނުންވާ ބަޔަކަށް "ޢައިރު މުސްލިމަކަށް" ވެސް، މީގެ ދަށުން ދެވިދާނެކަމަށް ޝެއިޚް ޢަބްދުﷲ ބަޔާން ކުރައްވައި ކަންބޮޑުވުން ފައުޅު ކުރެއްވިއެވެ.</div><div style="direction: rtl; padding-left: 5px; padding-right: 5px; text-align: justify; text-indent: 10px; unicode-bidi: embed;">އެހެންކަމުން މިބަޔާންވެވުނީ "ދީނީ އެއްބައިވަންތަކަމުގެ ޤާނޫނު" ގެ ނަމުގައި އަބޫ ޒުބައިދާ ވިދާޅުވި "ފުރަތަމަ ފިޔަވަހި" ތަންފީޛުކުރުމުގެ ގޮތުން އިތުރުކޮށް އަދި ފޮހެ "ކޮށާ މަށާ" ފައިވާ ނުކުތާތަކެވެ. ވިސްނާ ފިކުރުކުރާބަޔަކަށް ﷲ މަގުދައްކަވައެވެ.</div><div style="direction: rtl; padding-left: 5px; padding-right: 5px; text-align: justify; text-indent: 10px; unicode-bidi: embed;">ޝިއައީންގެ ޙަޤީޤަތަށް ބަލާއިރު، އެއުރެންނީ ކައުއިތުރު ޞަހާބީންނަށް ހަޑި ހުތުރު ބަސް އިއްވައި ފާޅުގައި އެއްޗެހިގޮވާ ބަޔެކެވެ. އަދި އަހަރެމެންގެ މަންމާފުޅު ޢާއިޝާ رَضِىَ اللَّهُ عَنْهَا އަކީ ފާޖިރު ބޭކަނބަލެއްކަމަށް ބުހުތާނުހަދައި، އަބޫ ބަކުރު، ޢުމަރު އަދި އުޘްމާނު – رَضِىَ اللَّهُ عَنْهُم ގެ މައްޗަށް ކުފުރާއި ބަދުބަހާއި މުޑުދާރުގޮވުން ގޮވާ ބަޔެކެވެ. ހަމަ މިފަދައިން ރަޝާދު ޚަލީފާއަށް އީމާންވާ ކުލަބުގެ މެންބަރުންނަކީވެސް އަބޫ ހުރައިރާ رَضِىَ اللَّهُ عَنْهُ އާއި އެނޫން ބޭފުޅުންނަށް ދޮގުބަސް ބުނެ އައިބުބުނާ ބަޔެކެވެ. ސަރުކާރުން ފުރަތަމަ ފިޔަވަހީގެ ތެރޭ މިކަންކަން ދިވެހިންތެރޭ ޢާންމު ކުރަން ޖެހެއެވެ. އެއީ އިހު ބުނެވުނު ޝިޢައީ އަދި އެނޫންވެސް "ސުންނަތްޖަމާޢަތާއި" ޚިލާފު ބައިގަނޑުތަކުގެ ދާޢީންގެ ބޭނުންކޮށްގެނެވެ. މިބައިމީހުން ދިވެހިފަސްގަނޑުގައި ކައު އިތުރު ޞަހާބީންނަށް މިބަސްތައް ރައްދުކުރުވައި ޢާންމުކުރުމުގެ ފުރުސަތު ދިނުމުގެ ގޮތުން އަންނިވި ނުކުތާ ފޮހެލާފައިވެއެވެ:</div><div style="direction: rtl; padding-left: 5px; padding-right: 5px; text-align: justify; text-indent: 10px; unicode-bidi: embed;">"<span style="text-decoration: underline;">ކީރިތި ރަސޫލާގެ އަޞްޙާބު ބޭކަލުންނަށް</span><span class="Apple-converted-space"> </span>... އިހާނާތްތެރިވާ ފަދަ އެއްވެސް ޢަމަލެއްކުރުން ނުވަތަ ބަހެއް ބުނުން ނުވަތަ އެއްޗެއް ކުރެހުމަކީ މަނާކަމެކެވެ."</div><div style="direction: rtl; padding-left: 5px; padding-right: 5px; text-align: justify; text-indent: 10px; unicode-bidi: embed;">ދީނީ މިފަދަ ބޮޑު ނުބައި ޢަޤީދާތައް އެންމެ ފަސޭހައިން ފެތުރުމަށް ބޭނުން ކުރެވޭނޭ އެއްޗަކީ މީޑިއާއެވެ. އެއީ އެމީޑިއާ ބޭނުންކޮށްގެން ވަކިބަޔެއްގެ ފިކުރިއްޔާތު މަތިވެރިކޮށް އަނެއްބަޔެއް ނިކަމެތިކޮށް، ޙާއްޤާއި ބާޠިލު އޮޅުވައި މީހުންގެ ސިކުނޑިތަކަށް އެ ބާޠިލު ދާއިމީ ގޮތަކަށް ފޯރުކޮށްދެވޭނޭ އެންމެ ބޮޑު ވަޞީލަތަކީ މިއީ ކަމަށްވާތީއެވެ. މިގޮތުން ޞަހާބީންގެ މައްޗަށް ނުބައި އެއްޗެހި ގޮވުމަށްޓަކައި އަންނަނިވި ނުޤުތާ އުނިކޮށްފައިވެއެވެ:</div><div style="direction: rtl; padding-left: 5px; padding-right: 5px; text-align: justify; text-indent: 10px; unicode-bidi: embed;">"...<span style="text-decoration: underline;">ޞަޙާބީއަކަށް</span><span class="Apple-converted-space"> </span>... ފުރައްސާރަކޮށްފައި ހުންނަ ޕްރޮގްރާމްތައް ދެއްކުން ނުވަތައަޑުފެތުރުމަކީ މަނާކަމެކެވެ."</div><div style="direction: rtl; padding-left: 5px; padding-right: 5px; text-align: justify; text-indent: 10px; unicode-bidi: embed;">ދެން އަންނަނިވި ނުކުތާ އުނިކޮށްފައިވެއެވެ:</div><div style="direction: rtl; padding-left: 5px; padding-right: 5px; text-align: justify; text-indent: 10px; unicode-bidi: embed;">"މާތްﷲ އަށް ނުވަތަ ކީރިތި ރަސޫލާ އަށް ނުވަތައެކަލޭގެފާނުގެ<span class="Apple-converted-space"> </span><span style="text-decoration: underline;">ޞަޙާބީއަކަށް</span>ނުވަތަ ކީރިތި ޤުރްއާނަށް ނުވަތަ ކީރިތި ރަސޫލާގެ ސުންނަތަށް ނުވަތަ އިސްލާމްދީނަށް ފުރައްސާރަކޮށް ... އިންޓަނެޓް ވެބްސައިޓް ނުވަތަ ބްލޮގް ނުވަތަ ނޫސް މަޖައްލާ ފަދަ ވަސީލަތެއް މެދުވެރިކޮށް ޝާއިޢުކުރުމަކީ މަނާކަކެމެވެ."</div><div style="direction: rtl; padding-left: 5px; padding-right: 5px; text-align: justify; text-indent: 10px; unicode-bidi: embed;">އަޅުގަނޑު މިޔަށް ކޮމެންޓެއްވެސް ދޭކަށް ބޭނުމެއް ނޫނެވެ. ކުރުގޮތަކަށް ނަބިއްޔާ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ އަށް ޢައިބު ފޮޓޯތައް ދިވެހި ނޫސް މަޖައްލާތަކުގައި ޢާންމުވުމަކީ އެކަށީގެން ގޯހަކަށް ނުވެދާނެއެވެ. ނުވަތަ ﷲ އަށް ހަޖޫ ޖެހުން މިބުނެވުނު ވަޞީލަތްތަކުގައި ފާޅުގައި އަމިއްލަ ނަމުގައި ކުރުމަކީ "މަނާކަމެއް" ނޫނެވެ. މިއީ އަބޫ ޒުބައިދާ ވިދާޅުވި ފުރަތަމަ ފިޔަވަހީގެ ނިމުމެވެ. އަދި އޭގެ ކުންނެވެ. މިފިޔަވަހީގެ ނިމުމަށް އަންއިރު، ޕާކިސްތާނުގެ އަޙްމަދީންނޭ ބުނެވޭ ޣުލާމު އަޙްމަދު ކައްޒާބު ރަސޫލެއްކަމަށް ބެލި "މުސްލިމުން" ނާއި، ރަޝާދު ޚަލީފާ ކައްޒާބު ރަސޫލެއްކަމަށް އީމާން ކުރި "ތިން ނަމާދު" ގުރޫޕާއި، ޢަލީ رَضِىَ اللَّهُ عَنْهُ އަކީ އިލާހެއްކަމަށް އީމާންވެ، 2އިންޗި 2 އިންޗީގެ ކަރުބަލާ ހިލަކޮޅެއް ނަމާދުގައި ނިއްކުރި ޖައްސަން ބޭނުންކުރާ ޝިއަޢީންނާއި، ބްރޭކްޑާންސް ނަމާދުގައި ކޮށް ތަފާތުވައްތަރަށް ބަނޑިއަޅުވަމުން އައްލާހޫ އައްލާހޫ ކިޔަމުން ފުމެމުންދާ، ނަމާދު ގެޔަށް ޤަބުރެއް ވައްދައި ސަޖިދަ ޖަހައިގެން ތިބޭ ސޫފީންނަށް މިސްކިތްތަކުގައި ނަމާދު ޖަމާޢަތް ހެދުމުގެ މިނިވަންކަން ލިބޭނެއެވެ. މިއީ "ނުވާނޭ" ކަމެއްނޫނެވެ. އިޒްރާއީލާއިއެކު ސިޔާސީ ގުޅުން ޤާއިމްކުރުމަކީ 3 އަހަރު ކުރިން އަހަރެމެން ހިތަށްވެސް ނާރާ ބީރައްޓެހި ކަމެކެވެ. އެހެނަސް މިހާރު ހަފްތާއަކު ދެފަހަރު ސަރުކާރުގެ މަންދޫބުން އެތަނަށްގޮސް އިޒްރޭލީ ޖަނަވާރުގެ އުސޫލުގެ އަނިޔާވެރިން މިތަނަށް ގެނެސް ހަދާއިރު ރައްޔިތުން ތިބީ ހަމަ ނަށާލަ ނަށާލައެވެ. އެންޑީޕީ ޢާންމުންގެ ފުރަގަހުގައި އެމެރިކާއާއިއެކު އެވަހާކަތައް ދައްކައި ނިންމުމުން އެކަމާއި ދެކޮޅު ހަދާލި މީހެއްވެސް މަދެވެ. އެހެންކަމުން މީޑިއާ އާއި އެނޫން ވަޞީލަތްތަކުގެ އެހީއާއިއެކު މިކަންކަން 5 ވަރަކަށް އަހަރުތެރޭވެސް ޤާއިމް ވުމަކީ އެކަށީގެންވާކަމެވެ. މިފަދަ ނަމާދު ޖަމާޢަތްތަކަށް ހުއްދަ ދިނުމުގެ ގޮތުން އަންނަނިވި ނުކުތާ އުވާލާފައިވެއެވެ:</div><div style="direction: rtl; padding-left: 5px; padding-right: 5px; text-align: justify; text-indent: 10px; unicode-bidi: embed;">"ސުންނަތް ޖަމާޢަތާ ޚިލާފަށް ދިވެހިރާއްޖޭގެ މިސްކިތްތަކުގައި ނަމާދުކުރުމަކީ މަނާކަމެކެވެ."</div><div style="direction: rtl; padding-left: 5px; padding-right: 5px; text-align: justify; text-indent: 10px; unicode-bidi: embed;">މިފިޔަވަހި ކުރިޔަށް ދާއިރު މަޑުމަޑުން ކުރިސްޓިއަން ދީނާއި އެހެން ދީންތަކުގެ ދައުވަތުތައް ދެވެމުންދާނެއެވެ. މިކަމަށްޓަކައި އެންމެ ފުރަތަމަ ހުޅުވާލާ ދޮރަކީ ކީރިތި ޤުރުއާނުގައިވާ ޢަދާވާތްތެރިކަމުގެ ޙުކުންތައް ފޮހެލުމެވެ. މިގޮތުން ޝެއިޚް ޢަބްދުﷲ އާއި ޝެއިޚް ފަރީދު މިކަން މަނާކުރުމަށް ބަޔާން ކޮށްފައިވާ މާއްދާއާއިމެދު ނުރުހުން ފާޅުކުރެއްވިއެވެ. ޝެއިޚް ފަރީދާއި ދެކޮޅަށް އިބުރާ ދެއްކި ވާހަކައިގައި ޖަމިއްޔަތުއް ސަލަފުގެ މައްޗަށް ދޮގުހަދައި ޔަހޫދީންނާއި ނަޞާރާއިންނާއި ދިމާލަށް "ހަޑި ހުތުރު" އެއްޗެހި ގޮވުމަށް ދީނުގައި ވާކަމަށް ބުނަނީ އޭ އިބުރާ ބުންޏެވެ. އެހެނަސް މިއީ ރައްޔިތުންނަށް އޮޅުވާލަށް ސަރުކާރުން ހެދިމަކަރެކެވެ. ޙަޤީޤަތަކީ ކާފަރުންނާއި ދެމެދު އޮންނަންޖެހޭ ޢަދާވާތްތެރިކަމުގެ މައްޗަށްވާ ޙުކުންތައް ފޮހެލުމަށް މަސައްކަތްކުރުމެވެ. އަދި އެފަދަ ބަހެއް ބުނުމުގެ މިނިވަންކަންވެސް ނުދިނުމެވެ. އެނުކުތާ ގައިވަނީ "އެއްވެސް ދީނެއްގެ އަޙުލުވެރިންނާމެދު މީސްތަކުންގެ މެދުގައިރުޅިވެރިކަމާއި ނަފުރަތު އުފައްދައި... ވާހަކަނުދެއްކުން" އެވެ. ޝެއިޚް ޢަބްދުﷲ ވިދާޅުވީ މިނުކުތާގެ ސަބަބުން އަލްޙަމްދު ސޫރަތުގެ މާނަވެސް ކިޔުން "މަނާކުރެވިދާނޭ" ކަމަށެވެ. އެހެންކަމުން ލާދީނީ ސަރުކާރެއްގެ އަތަށް މިފަދަ ބާރެއް ލިބިއްޖެނަމަ މިޤަވާޢީދުގެ ދަށުން ޤުރުއާނުގެ އެތައް ތަނެއް މަނާކުރެވިދާނެއެވެ. އަދި އިޒްރާއީލަކީ ޔަހޫދީ ސްޓޭޓެއްކަމަށް ވެފައި އިޒްރާއީލަށް އެއްޗެއް ބުނުމަކީ ޔަހޫދިއްޔަތަށް އެއްޗެއް ބުނުންކަމަށްވެފައި، އިޔަހޫދީކަމަކީ އިންސާނިއްޔަތުވެސް އެކަމަކާ ދެކޮލުކަމެއް ކަމަށް ވާހިނދުގައިވެސް މިކަން މަނާކުރެވިދާނެއެވެ. އަދި މީގެ ދަށުން ފަލަސްޠީނަށްޓަކައި ކުރާ މުޒާހަރާއެއްގައި އިޒްރާއިލަށް އެއްޗެއް ބުނުންވެސް މަނާކުރެވިދާނެއެވެ.</div><div style="direction: rtl; padding-left: 5px; padding-right: 5px; text-align: justify; text-indent: 10px; unicode-bidi: embed;">ރާއްޖޭގެ އަދި ދުނިޔޭގެ ތާރީޚަށް ބެލިޔަސް ކުޑަކުދިންނަށް ތަފާތު ލާދީނީ އަފްކާރުތައް ފެތުރުމަށް ބޭނުންކުރާ އެންމެ ބޮޑު ބައިގަނޑަކީ ޓީޗަރުންގެ ނަމުގައި އަންނަ މިޝަނަރީސް އެވެ. އެހެންކަމުން މިފަދަ މިޝަނަރީސްއަށް ދީން ފެތުރުމުގެ ހުއްދަދީ މަގުފަހި ކުރުމުގެ ގޮތުން އަންނަނިވި ނުކުތާ ފޮހެލާފައިވެއެވެ:</div><div style="direction: rtl; padding-left: 5px; padding-right: 5px; text-align: justify; text-indent: 10px; unicode-bidi: embed;">އެއީ މިފަދަ ޓީޗަރުންނާއި އެނޫން ކާފަރުން ގެންގުޅޭ ޞަލީބާއި ބުދުތަކާއި "<span style="text-decoration: underline;">އަޅުކަންކުރަން ގެންގުޅޭތަކެތި</span>" ފާޅުވާގޮތަށް ގެންގުޅުމަށް ލުއި ދީފައިވުމުގެ އިތުރުންނެވެ.</div><div style="direction: rtl; padding-left: 5px; padding-right: 5px; text-align: justify; text-indent: 10px; unicode-bidi: embed;">ދެން އޮތީ ފުރަތަމަ ފިޔަވަހީގެ ފަހު ކޮޅު ތަންފީޛުކުރާނޭ ފިޔަވަހިތަކެވެ. އެހިނދުވެސް އެހެންދީނަކަށް އުޅުމުގެ މިނިވަންކަމެއް އަދި ހުޅުވައެއް ނުލާނެއެވެ. އެހެނަސް މިފިޔަވަހީ ގައިވަނީ އެއަށްޓަކައި މާހައުލު ތައްޔާރުކުރުމެވެ. އެބައިމީހުންނަށް އަޅުކަން ކުރާނޭ ފައްޅިއާއި ކިނާސާ އަޅައިދިނުމެވެ. ފަހަރެއްގައި ޓުއަރިސްޓުންގެ ނަމުގައެވެ. އަދި މިކަން ޤާނޫނު ނެރުމުގައި ވަރަށް ސާފުކޮށް ބަޔާންވެފައިވެއެވެ. އެއީ އެންމެ ފުރަތަމަ އަންނަނިވި ނުކުތާ ފޮހެލާފައިވުމެވެ:</div><div style="direction: rtl;
